Terms of Service

1. Agreement to these Terms

These Terms govern your access to and use of Brinley North, a family routine and growth platform operated by LumaNavi LLC (“LumaNavi,” “we,” “us,” “our”). You accept these Terms by checking the acceptance boxes presented at sign-up. If you do not agree, do not create an account or use the service. Access is sold on a subscription basis to the adult who holds the parent account.

2. Your account

You must be at least 18 years old to create a parent account. You are responsible for activity under your account, including activity by anyone you give access to, and for keeping your credentials confidential.

Tell us promptly at hello@lumanavi.com if you believe your account has been accessed without your permission.

3. Children’s accounts

A child profile can only be created by a parent or legal guardian, and only after we obtain verifiable parental consent by email. A child cannot create an account, authorize a device, or consent on their own behalf.

By creating a child profile you confirm that you are that child’s parent or legal guardian and that you consent to the collection and use of their information as described in our Privacy Notice.

You may withdraw consent at any time by deleting the child profile or closing your account. Withdrawal ends further collection and erases the child’s data, except records we must keep to show that consent was properly obtained.

4. Acceptable use

Use Brinley North lawfully, and for your own family. You agree not to:

• create a child profile for a child who is not in your care
• share your account with people outside your household
• attempt to access another family’s data
• interfere with the service’s operation or security, or probe, scan, or test its infrastructure except as permitted by law
• scrape, reverse engineer, or resell any part of the platform
• use the service to harm, exploit, or deceive a child

5. Subscription and payment

Subscription fees are billed on a recurring basis — monthly or annually, as selected at signup — through Stripe, or through Apple where you subscribe inside an iOS app. By subscribing you authorize the applicable processor to charge your payment method each billing period.

Fees are non-refundable except at our discretion or where the law requires otherwise. If you believe a charge was made in error, contact us within 30 days at hello@lumanavi.com. Failure to keep a valid payment method on file may result in suspension; we will give reasonable notice first where practicable.

6. Your data

The information you and your family put into Brinley North remains yours. We do not claim ownership of it, we do not sell it, and we do not share it with advertising networks or data brokers. What we collect, why, how long we keep it, and how to remove it are described in our Privacy Notice, which forms part of these Terms.

7. Intellectual property

The service and its content — including text, graphics, logos, the LumaNavi name and monogram, the Brinley™ family of marks, taglines, and design — are owned by LumaNavi LLC or its licensors and protected by intellectual-property law, whether or not a given mark appears on a particular screen. You may not copy the design, reproduce substantial portions of the content, or use our names, marks, or taglines in a way that implies affiliation, endorsement, or certification, without prior written permission.

8. Third-party services

Brinley North links to other LumaNavi ecosystem surfaces and relies on third-party providers, including payment processors and app stores. Linked surfaces and third-party services are governed by their own terms and policies. LumaNavi does not control and is not responsible for third-party sites.

9. Disclaimer of warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, LUMANAVI DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. LUMANAVI DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LUMANAVI IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE. LUMANAVI’S TOTAL AGGREGATE LIABILITY IS LIMITED TO THE AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM.

For purposes of sections 9 through 11, “LumaNavi” includes LumaNavi LLC and its ecosystem brands, products, and surfaces. Nothing in these Terms limits liability that cannot be limited under applicable law.

11. Indemnification

You will defend, indemnify, and hold harmless LumaNavi from claims arising out of your misuse of the service or your breach of these Terms.

12. Governing law & dispute resolution

These Terms are governed by the laws of Wisconsin, without regard to conflict-of-laws rules. The parties submit to the exclusive jurisdiction of the state and federal courts located in Milwaukee County, Wisconsin.

Before formal proceedings, the parties will attempt good-faith resolution for 30 days after written notice of a dispute.

13. Termination

You may cancel at any time; cancellation takes effect at the end of the current billing period and access continues until then. Closing your account erases your family’s data as described in the Privacy Notice.

We may suspend or terminate access for material breach, with notice where reasonably practicable, and immediately where a violation puts a child at risk.

14. Changes to these Terms

We may update these Terms prospectively. The “Last revised” date will change and material changes will be communicated as required. Where a change affects how we handle a child’s information, we will obtain fresh parental consent if the law requires it.

15. General

Severability; no waiver; no assignment by you without our consent. Together with the Privacy Notice, these Terms are the entire agreement regarding your use of Brinley North.
